Minnesota's ban on same-sex marriage has been voided by a federal court, dealing a major blow to the conservative Christian stronghold's attempt to preserve the constitutional ban on gay marriage.
A three-judge panel for the Eighth Circuit Court of Appeals issued a 16-page ruling Tuesday declaring Minnesota's ban on same-sex marriage void as unconstitutional. The law “fails to advance any rational basis to protect the state’s legitimate interest in procreation and child rearing,” the panel wrote, adding that Minnesota’s ban violates the Equal Protection Clause.
Judge Richard S. Arnold wrote the opinion for the panel, which also included Judge Susan Richard Nelson and Judge Diana Murphy.
The resolution was the first major defeat for Minnesota Attorney General Lori Swanson, who sent a letter to U.S. Supreme Court Justice Anthony Kennedy last week. Kennedy had been the pivotal vote in a 5-4 decision striking down the federal Defense of Marriage Act last year.
Swanston wrote that Kennedy's opinion in the DOMA case suggested that he would have likely found Minnesota's ban on same-sex marriage unconstitutional.
“In the absence of Kennedy’s footnote 15, there might be some doubt whether the Supreme Court would review the constitutionality of Minnesota’s marriage laws in the same post-DOMA context in which it reviewed California’s marriage laws and concluded that ‘the Constitution compels’ invalidation of Proposition 8,” Swanson wrote.
As a result of the ruling, same-sex marriages could be performed in the state next week as the case is appealed to the U.S. Supreme Court.
The case was brought by Lambda Legal on behalf of a Minnesota gay couple who were denied a marriage license.
